WPC Approval (Wireless Planning & Coordination Wing)

Wireless Planning & Coordination Wing (WPC) is the licensing authority for amateur radio licenses, frequency spectrum, and any other wireless monitoring frequency spectrum in India.

Products with radio and/or wireless functionalities which are imported or manufactured and marketed in India must have an Equipment Type Approval (ETA) & Import Licence (IL) certificate from the Wireless Planning and Coordination (WPC) wing of the Ministry of Communications of the government of India . This includes products with Bluetooth, wireless local area network access technology (Wi-Fi), small digital radios (Zigbee), and radio frequency identification (RFID) among others.

About the BEE qualification program

As mentioned earlier, the BEE sets the standards and the label to mark the star rating of various devices. They also define testing and certification procedures for all types of devices.

When manufacturers create a new model and want the product to be certified, they test their device according to the procedures designed by BEE and request the certification of stars with test data. Based on the test data, the BEE provides a star rating for the devices. EEB continues to refine certification standards and procedures periodically. For certain products BEE has defined minimum standards for which a product must pass in order to get license to sell in Indian markets. Every individual or an entity dealing with pre-packed commodities shall register themselves as a 'Manufacturer'/ 'Packer' or an 'Importer' with the Director/Controller of Legal Metrology in the concerned Jurisdiction. The Legal Metrology (Packaged Commodities) Rules, 2011 (Rules) completely provide for all statutory requirements to be followed by persons dealing with and declarations to be made with respect to 'Packaged commodities'.

Rule 27 of the said Rules provides for the procedure for Registration as a 'Packer' or 'Importer'. Scope and its Applicability: Rule 27 contains provisions relating to Registration as a 'Manufacturer', 'Packer' and an 'Importer'. Before analyzing the procedure for registration, it is important to understand the differences between the terms 'manufacturer' and 'packer'.
According to Rule 2(d), the term 'Manufacturer' means and includes any person / Firm, who
Produce/ make / manufacture a commodity
Puts, or causes to be put, any mark on any packaged commodity and the mark claims the commodity in the package to be a commodity produced, made or manufactured by such person or firm.
On the other hand Rule 2(g) defines 'Packer' as a person / Firm, who which pre-packs any commodity in any bottle, tin, wrapper or otherwise, in units suitable for sale whether wholesale or retail.

The term 'pre-packed commodity' means a commodity which without the purchaser being present is placed in a package of whatever nature, whether sealed or not, so that the product contained therein has a pre-determined quantity;[1]

Rule 27 provides provision for two licenses- Packer and an Importer. The Rule lays down that the registration is applicable for any person who prepacks or imports any commodity for sale distribution or delivery.

Timeframe:

Application in this regard shall be made before the Director/Controller of Legal Metrology as the case may be made within ninety days from the date on which he or it commences such pre-packing/importing.

Form and manner:
Every Applicant shall submit an Application for Registration before the Director/Controller as the case may be, containing the following particulars:

  • (a) The name of the applicant;
  • (b) The complete address of the premises (One or more) at which the pre-packing or import of one or more commodities is made by the applicant;
  • 'Complete address' means, the postal address at which the factory is situated. In any other case, the name of the street, number (if any) assigned to the premises of the manufacturer or packer and either the name of the city and State where the business is carried on by the manufacturer or packer or the Postal Index Number [PIN] Code.[2]
  • The name of the commodity or commodities pre-packed or imported by the applicant.
  • In addition to the above particulars of goods imported and the names of the countries from which the goods are imported are to be given in case of application to register as an importer.


Registration of a shorter address is allowed if the Controller/Director is satisfied that such address is sufficient to enable the consumer or any other person to identify the manufacturer or the packer.[3]
The Application along with the supporting documents are required to be submitted along with the fee of Rupees Five Hundred. Upon verification of the Application and the documents, the Controller/Director as the case may be will issue the certificate of Registration as a 'packer' or 'Importer'.

Amendment to the Certificate of Registration:
Any amendment to be carried out in the certificate of registration shall be communicated to the Registrar in writing along with a fee of rupees one hundred.

Offenses and Penalty:

Whoever contravenes the provisions of rules 27 to 31, he shall be punished with fine of four thousand rupees. In case if the violation is committed by a company, every director or person in-charge shall be punished independently.

It is pertinent to note that, the Registration under Rule 27 is mandatory for all 'pre-packed commodities'. In spite of the definition provided in the Legal Metrology Act 2009, there is ambiguity in interpretation of the said term. Even though various High Courts and the Supreme Court have tried to interpret the term in various Judicial Precedents, lack of clarity in this regard still prevail among firms/ entities in complying with the provisions of these Rules.

BIS Certification & Registration

In 2012 Compulsory Registration Scheme (CRS) was introduced by Department of Electronics and Information Technology (DeitY) now called Ministry of Electronics and Information Technology (MeitY) along with Bureau of Indian Standards (BIS). BIS Registration is essential for all the electronic products which are listed in Compulsory Registration Scheme (CRS) and If you want to sell the particular product in India.All manufacturers regardless (foreign or Indian) need to apply for this registration to Import the product in India or for doing sales in to Indian market.

Highlights of BIS

  • The products are tested for safety as per the applicable IS standard.
  • Overseas Manufacturers are required to have a local representative in India who will represent the manufacturer locally and will be responsible for placing the product in the market.

Marking Requirements: Standard mark for CRS to be marked on the products and packaging after BIS registration is granted.

Test Report: Issued by BIS Recognized Testing Laboratory in India (Foreign labs are not recognised for this program) and as per the series guidelines issued by MeitY, a report can cover maximum of ten (10) models in a series. Domestic Manufacturers Certification Scheme: Under this certification,an applicant is required to submit the application form to the local BIS Branch office after which a preliminary evaluation takes place by the corresponding BIS officer. Manufacturer place is checked for its capability, technical personnel and samples for independent testing. Grant of license is considered after a sample product passes the regular testing with respective Indian standards.The whole process generally takes around 4 months and 6 months in case of all India first licenses. There are also specific laboratories which test products and then these reports are needed to submit along with application form. With verification and testing, the acceptable license is granted too.

Foreign Manufacturers Certification Scheme (FMCS):This certification is given to foreign manufacturers for using Indian Certification mark on their products except Electronics & IT Goods notified by DeitY.

ECO Mark Scheme:Under this product certification schemes ECO Mark is applied to the products that are specified to Environment-friendly products only. The whole process is same with some specific manufacturer's policy to follow separately.

NORMAL PROCEDURE FOR LICENSE GRANT

The procedure for granting the BIS certification license begins with the submission of the application on the application form prescribed by the manufacturer wishing to obtain the license. When reviewing the application and the documents attached to the facilitation desk, if the application is complete in all respects, an application number is recorded and assigned.

PRELIMINARY INSPECTION

The preliminary inspection of the unit is carried out on the date allocated after the registration of the order. During this inspection, the company's capabilities and manufacturing controls, quality control techniques, available testing facilities, and the technical skills of the personnel are assessed. Samples of the products are tested and also extracted for analysis at the laboratories specified for the product. Fees for preliminary visits are billed at the rate set by the BIS from time to time. The applicant must pay the costs of the test established during a preliminary visit to an independent test. During preliminary checks, tests and control procedures, the product marking rate is discussed with the applicant's administration.

LICENSING

The license for the use of the standard trademark on a product is granted only after the BIS has guaranteed the manufacturer's ability to manufacture the product in accordance with the corresponding Indiana standard on a continuous basis. This is done through a preliminary factory assessment to determine the manufacturer's ability to produce the goods in accordance with the Indian standard, including raw materials, manufacturing process, manufacturing capacity and control facilities. including test equipment and monitoring staff. Samples are tested at the factory. Simultaneously, samples are also taken for analysis in independent laboratories to assess their compliance with the relevant standard. The manufacturer must agree to use a well-defined testing and inspection program, as approved from time to time by BIS, which prescribes specific tests and their frequency of completion. The manufacturer must also agree to pay the fees set by the BIS for the product. The license is granted only if the manufacturer accepts these conditions and if the inspection and test reports at the factory are satisfactory.

VALIDITY

The initial period of validity of the license is one year. The license may be renewed for an additional period of one to two years, subject to satisfactory exploitation of the license, as observed during periodic inspections, factory tests and independent samples taken at the factory and on the market.

With their pollutionsur mounting and increasing year after year, Indian Government started gave EPR policy in 2011 and further accredited CPCB for authorising certification with EPR.

Central Pollution Control Board CPCB has been given the authority to authorise new E-waste rules under the jurisdiction of Environment ministry.
